CBAM Carbon Tax Deduction: Can CCTS Cut Your EU CBAM Bill?
Can Indian exporters deduct CCTS costs from the EU CBAM carbon tax? Article 9 rules, the India-EU FTA CBAM annex and what a compliant plant can claim.
Indian exporters keep hearing two hopeful phrases: "the FTA has a CBAM annex" and "Article 9 lets you deduct carbon prices paid at home." Here is what each actually means for your EU CBAM bill, as of 22 October 2026.
What Is a CBAM Article 9 Deduction?
Article 9 of the EU CBAM regulation lets an importer reduce the certificates owed by the carbon price effectively paid in the country of production. The Commission published draft implementing rules on 13 May 2026; consultation closed on 10 June. As of 22 October 2026 they have not been adopted, and the draft recognises no country's scheme yet.
Can a CCTS Plant Claim It?

This is the catch. Under India's CCTS, a plant that meets its target buys no CCCs and pays no penalty, so it has no monetary carbon price to point to. A plant that missed and paid 2× environmental compensation has a rupee figure. The UK has accepted CCTS for relief; the EU has not.
What Does the India-EU FTA CBAM Annex Promise?

On 30 July 2026, Additional Secretary Darpan Jain described three pillars: any future CBAM flexibility passes to India, a dialogue so carbon price "already paid in India" is considered, and support for EU recognition of Indian verifiers. The FTA text confirms no CBAM exemption (more on the FTA). No thresholds or timelines are public.
Is India Getting Ready on Verification?
Yes. A Committee on Export Preparedness for EU CBAM is in place, Indian verifiers gained access to the EU CBAM registry in September 2026, and India is pushing for EU recognition of NABCB so audits can happen in India. Returns are due from September 2027.

So What Should Exporters Do?
Better data won't create a deduction, but it does stop default values from setting your bill. ICT helps exporters build verified, installation-specific emissions records through our dMRV platform, ready for both CCTS and CBAM.

Frequently Asked Questions
- What is a CBAM Article 9 deduction?
- It lets an EU importer reduce CBAM certificates owed by the carbon price effectively paid in the country where the goods were made.
- Have the Article 9 implementing rules been adopted?
- No. The Commission published a draft on 13 May 2026, but as of 22 October 2026 the rules have not been adopted and no country is recognised.
- Can a CCTS-compliant plant deduct anything under CBAM?
- Probably very little. A plant that meets its CCTS target pays no carbon price, so it has no monetary amount to deduct.
- Does the India-EU FTA exempt Indian exporters from CBAM?
- No. The FTA text keeps CBAM fully applicable. The CBAM annex sets up a dialogue and a flexibility pass-through but no exemption.
- When must Indian exporters file CBAM returns?
- Annual CBAM declarations for 2026 imports are due by 30 September 2027. Indian verifiers gained EU registry access in September 2026.
